Terms of Service
Last updated: 7/29/2026 · Contact: support@breezecheck.com
1. Introduction and acceptance
By accessing or using BreezeCheck, creating an account, submitting content, or purchasing a plan or credit pack, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service. For questions, email support@breezecheck.com.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use BreezeCheck. By using the service you represent that you meet this requirement.
3. Account registration and security
You are responsible for your account credentials, for activity that occurs under your account, and for providing accurate information. BreezeCheck may restrict, suspend, or remove accounts involved in duplicate, alias-based, abusive, or fraudulent behavior, or in circumvention of plan limits or credit controls.
4. What BreezeCheck does
BreezeCheck is a structured consumer review workflow that helps you check what you hear, read, or see, save reviews, group them into collections, add follow-up actions, and optionally share individual reviews. It may generate source-backed summaries, verdict signals, limitations, and evidence context. BreezeCheck is not a truth detector, fact-checking authority, or generic chatbot, and does not provide certifications about people, creators, brands, or content.
5. General information only — no professional advice
BreezeCheck provides general information and evidence summaries only. It does not provide medical, legal, financial, tax, cybersecurity, nutrition, safety, diagnosis, treatment, investment, or other professional advice, and is not a substitute for consultation with a qualified professional in your jurisdiction. You are responsible for your decisions. Paid plans provide more credits and plan features; they do not change how reviews are produced and do not make results more accurate.
6. AI, source, and output limitations
Reviews are produced with automated systems and public or user-provided information. Results may be incomplete, outdated, wrong, biased, or based on limited available sources. Source availability varies over time. Screenshots, images, and label photos may be unclear or partial. BreezeCheck does not guarantee the accuracy, completeness, reliability, timeliness, or suitability of any output. Do not rely on BreezeCheck as the only basis for important decisions.
7. User content and uploads
You retain ownership of the content you submit. You grant BreezeCheck a limited, worldwide, royalty-free license to host, store, process, transmit, analyze, and display your content solely to operate the service for you, provide support, prevent abuse, meet legal obligations, and improve product quality. You represent that you have the rights necessary to submit the content and that it does not violate applicable law or the rights of any third party.
8. Prohibited content
You may not submit or upload: (a) content that is unlawful, infringing, defamatory, obscene, or hateful; (b) child sexual abuse material or content that sexually exploits or endangers minors; (c) content that harasses, threatens, doxes, impersonates, or targets any person or group; (d) content you do not have the right to submit, including content that violates another person's privacy, publicity, contractual, or intellectual-property rights; (e) malware, phishing payloads, or malicious code beyond a safe review context; (f) credentials, government-issued identifiers, financial account numbers, or other sensitive personal information about others without their authorization; or (g) content intended to use BreezeCheck to publicly rank, shame, defame, or retaliate against any individual. BreezeCheck may remove content and suspend accounts that violate this section.
9. Privacy, private records, and public sharing
Your Library, Collections, Action List, private notes, ratings, and personal decision context are private to your account unless you intentionally use a supported sharing feature. When you create a public share link, the information that link exposes may be visible to anyone who has the link. Private notes, personal ratings, and personal decisions are excluded from shared reviews. See our Privacy Policy for details on how information is handled.
10. Creator Review and sampled content
Creator Review is based on a limited sample of public or user-provided content and evidence patterns. It is not a full audit of a creator, person, organization, account, or body of work, and must not be used as a public rating, credibility score, trust score, or definitive judgment about anyone's intent, character, honesty, or expertise.
11. Product labels, emails, suspicious content, and third-party material
Product-label reviews are based on visible submitted label information and available sources. Suspicious-email and message reviews are general risk-signal summaries and are not cybersecurity advice or guaranteed fraud detection. Third-party websites, articles, platforms, sources, and materials referenced by or linked from BreezeCheck are outside of our control; you access them at your own risk.
12. Acceptable use
You agree not to: (a) use the service unlawfully; (b) harass, threaten, defame, or upload abusive content; (c) upload content you do not have rights to; (d) attempt to bypass rate limits, credits, paywalls, plan gates, or duplicate-account controls; (e) scrape, crawl, bulk-extract, reverse engineer, or use automated tools to abuse the service; (f) probe, scan, or attack the security of BreezeCheck; (g) resell, sublicense, or provide the service to third parties as a paid or bundled offering; (h) use BreezeCheck as the sole basis for high-stakes professional decisions without qualified review; (i) submit malware, phishing material beyond a safe review context, or illegal content; (j) impersonate or misrepresent your identity or affiliation; (k) use outputs to harass, defame, rank, or publicly shame individuals; or (l) misrepresent BreezeCheck outputs as official verification, certification, guaranteed truth, or professional advice.
13. Intellectual property
BreezeCheck and its licensors own the app, software, branding, designs, workflows, logos, documentation, and all related intellectual property. You are granted a limited, revocable, non-transferable, non-sublicensable license to access and use the service for its intended purpose. You may not copy, modify, reverse engineer, resell, or create derivative products or services from BreezeCheck except as expressly permitted by these Terms or applicable law.
14. Feedback license
If you send us ideas, suggestions, ratings, comments, bug reports, or other product feedback, you grant BreezeCheck a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and incorporate that feedback in our products and services without notice, compensation, or attribution. This license applies only to the feedback itself and does not make your private submissions or account content public.
15. Credits
Free accounts receive 25 starter credits and then 5 free credits each week. Free weekly credits refresh weekly and do not stack. Plus and Pro paid plan credits and purchased top-up credits roll over while your account remains open and in good standing. Promotional, gifted, referral, goodwill, or admin-granted credits may be issued with expiration or usage terms, which are shown at the time of grant. Credits are used only for BreezeCheck reviews and are not redeemable for cash, transferable, resellable, or exchangeable. Credits already spent are non-refundable, except that when a review fails after credits are spent, the app automatically refunds those credits. BreezeCheck may adjust or remove credits tied to fraud, chargebacks, payment failure, duplicate-account abuse, or Terms violations.
16. Paid plans, subscriptions, renewals, and taxes
Plus and Pro plans renew automatically until canceled. Annual plans bill once per year and keep the same monthly credit allowance each month. By subscribing you authorize recurring charges to your payment method. Taxes may apply based on your location. Payments are processed by our payment provider. You can cancel at any time through the supported billing flow; cancellation takes effect at the end of the current billing period, and your access continues until then.
17. Top-ups
Top-up credit packs are one-time purchases. Purchased top-up credits are used for BreezeCheck reviews and are not redeemable for cash, transferable, resellable, or exchangeable. Purchased top-up credits roll over while your account remains open and in good standing, and are used after your plan's monthly credits are consumed.
18. Refunds
Top-up credit purchases are one-time and non-refundable once fulfilled, except where required by law. Subscription payments are generally non-refundable, except where required by law or expressly stated in writing by BreezeCheck. When a review fails after credits are spent, the app automatically refunds those credits. BreezeCheck does not otherwise guarantee refunds for unused credits, unused subscription time, or account termination for cause.
19. Support, feedback, and admin review
Support requests, feedback submissions, and flagged content may be reviewed by BreezeCheck administrators for support, safety, abuse prevention, quality assurance, and product improvement. Feedback you provide may be used to improve the service without obligation to you. Admin review does not make your private user content public.
20. Advertising, testimonials, and endorsements
Users, affiliates, testers, referrers, contractors, and partners may not make false, misleading, deceptive, unsubstantiated, or unauthorized claims about BreezeCheck, and may not describe BreezeCheck as a truth detector, verifier of truth, guarantee of accuracy, provider of medical, legal, financial, tax, or cybersecurity advice, ranker of people, certifier of creators, or source of official verification. Any endorsement, testimonial, sponsored post, referral promotion, affiliate promotion, review, or other public statement that involves compensation, free credits, discounted access, or any other material connection to BreezeCheck must clearly and conspicuously disclose that connection in the same content. BreezeCheck may require correction, removal, or clarification of promotional content that is inaccurate, non-compliant, or inconsistent with these Terms.
21. User reviews and testimonials
If you post a testimonial, review, or endorsement about BreezeCheck on any platform, it must reflect your honest opinion and actual experience with the service. You may not submit or arrange for fake reviews, AI-generated fake reviews, reviews from people who have not used BreezeCheck, or reviews that hide a material connection to BreezeCheck. You may not offer, receive, or arrange incentives for positive reviews without clearly disclosing the incentive, and you may not suppress or attempt to manipulate negative reviews through threats, intimidation, or misleading conduct.
22. Third-party services
BreezeCheck relies on third-party services, which may include payment processors, backend and hosting infrastructure, email providers, source and search providers, app stores, and social platforms. Those services are governed by their own terms and privacy policies. BreezeCheck is not responsible for third-party content, services, or outages outside its control.
23. Service availability and changes
BreezeCheck may modify, suspend, discontinue, limit, or update features, sources, review formats, credit allowances, plan features, or availability at any time, prospectively. Some features may be labeled beta or experimental. BreezeCheck does not guarantee uninterrupted or error-free availability.
24. Suspension and termination
BreezeCheck may suspend or terminate your account or access for violations of these Terms, fraud, abuse, payment failure, chargebacks, security risk, legal requirements, or misuse. You may stop using the service at any time, cancel paid plans through the supported billing flow, and delete your account and data from the Profile page. On termination, unused credits and access to paid features may end, subject to applicable law.
25. Warranty disclaimer
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, BreezeCheck disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. BreezeCheck does not warrant that the service will be accurate, complete, secure, uninterrupted, or free of errors.
26. Limitation of liability
To the fullest extent permitted by law, BreezeCheck and its officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill, arising out of or related to your use of the service, even if advised of the possibility of such damages. BreezeCheck's aggregate liability for any claim arising out of or related to the service will not exceed the greater of the amount you paid BreezeCheck in the six months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
27. Indemnification
You agree to defend, indemnify, and hold harmless BreezeCheck and its officers, employees, and contractors from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: your content; your use or misuse of the service; your violation of these Terms; your violation of applicable law; or your infringement of any third-party right.
28. Informal dispute resolution
Before starting any formal legal action, arbitration, or small-claims case arising out of or related to these Terms or the service, you agree to first send written notice of the dispute to support@breezecheck.com describing the issue, the parties involved, and the relief you seek, and to work with BreezeCheck in good faith to resolve it informally for at least thirty (30) days. This informal step is a required condition to filing any formal claim. The 30-day informal period tolls any applicable statute of limitations for that period.
29. Binding arbitration; class-action and jury-trial waiver
Please read this section carefully. Except for the carveouts below, you and BreezeCheck agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding individual arbitration, and not in court, and each side waives the right to a jury trial and the right to participate in a class, collective, consolidated, private attorney general, or representative action, to the fullest extent permitted by law. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. If AAA is unavailable or declines to administer, the parties will select a comparable arbitration provider that offers consumer arbitration under substantially similar rules, such as JAMS. The arbitration will be seated in Clark County, Nevada, and may be conducted by video, telephone, or on documents where the provider's consumer rules allow. Consumer fee allocation follows the applicable provider's consumer rules and due-process standards. The arbitrator may award any relief a court could award in an individual case, but may not award class or representative relief. Carveouts. Either party may (a) bring an individual action in a small-claims court that has jurisdiction; and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or stop actual or threatened intellectual-property infringement, misappropriation of confidential information, unauthorized access, security breaches, or other abuse of the service. Opt-out. You may opt out of this arbitration agreement by emailing support@breezecheck.com within 30 days after you first accept these Terms (or within 30 days after a material change to this arbitration section) with the subject line "Arbitration opt-out" and stating your name, account email, and that you wish to opt out. Opting out will not affect any other part of these Terms. Mass arbitration. If 25 or more similar arbitration demands are filed by or with the coordinated assistance of the same law firm or coordinated group against BreezeCheck within a 60-day window, the parties agree that the arbitration provider's mass-arbitration or bellwether procedures (if any) will apply. If the provider has no such procedures, the parties will work with the provider in good faith to adopt a staged, bellwether process that preserves due-process rights of each claimant while allowing efficient resolution. Severability. If the class, collective, or representative-action waiver is held unenforceable as to a particular claim, that specific claim will be severed from arbitration and brought in court, and the remainder of this section will remain in effect. If any other part of this arbitration agreement is held unenforceable, the rest of this section will remain in effect to the fullest extent permitted by law.
30. Governing law and venue
These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-laws principles. For any matter that is not subject to arbitration under Section 29 (including the arbitration carveouts and any claim held non-arbitrable), the exclusive venue is the state or federal courts located in Clark County, Nevada, and you and BreezeCheck consent to personal jurisdiction there.
31. Apple, Google, and app-store terms
If you access BreezeCheck as a progressive web app or through an app store, additional third-party terms from Apple, Google, or another store may apply. Apple, Google, and other app-store providers are not parties to these Terms and are not responsible for BreezeCheck except as required by their own terms.
32. Changes to the Terms
BreezeCheck may update these Terms from time to time. When we make material changes we will update the "Last updated" date below and, where appropriate, provide notice or ask you to re-accept. Your continued use of the service after an update means you accept the revised Terms, subject to applicable law.
33. Notices and contact
For support, privacy, deletion, and legal notices, email support@breezecheck.com. BreezeCheck may update this contact information from time to time; the most current contact information will be posted on this page.
34. Miscellaneous
These Terms, together with the Privacy Policy and any other referenced policies, are the entire agreement between you and BreezeCheck regarding the service. If any provision is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. Failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; BreezeCheck may assign them in connection with a merger, acquisition, reorganization, or sale of assets. Neither party is liable for delays or failures due to events beyond reasonable control (force majeure). Sections that by their nature should survive termination — including credits, refunds, IP, feedback license, disclaimers, limitation of liability, indemnification, informal dispute resolution, arbitration, governing law, and miscellaneous provisions — will survive. Headings are for convenience only.
